Intel case tests email as free speech

A disgruntled ex-Intel employee is sending email to coworkers to complain about mgmt and leak layoff news, etc. Intel cant get him for trespassing on their property, so they are suing him for "trespass to chattels," a 270-year-old legal principle. The world is waiting to see what this means. Browsing a web site or sending unsolicited email could become a crime.

"We are trying to make the public aware that the soul of the Internet is at stake here," says William McSwain, a lawyer at Dechert LLP in Philadelphia, the firm representing Mr. Hamidi on a pro bono basis.
