COMPLAINT

I. Introduction

1. mis is an action pursuant to the Lanharn Act, 15 U.S.C. Section 1 125(a)(l)(B) and 28 U.S.C. Section 1337, seeking redress for damages caused by fake advertising and trade libel on the Internet. Plaintiff~ seek flirther redress based on common laW claims of defamation and libel for malicious and false statements published by the Defendant on the Internet. Venue is proper under 28 U.S.C. Section 1391, in the Eastern District of Virginia, as the acts complained of occurred in Prince William County, Virginia; the Defendant transacts business on the Internet in Prince William County, Virginia; and the Plaintiffs' business which is the subject of this action, is situated in Prince William County, Virginia.

II. Jurisdiction

2. This Court has jurisdiction over this action under 28 U.S.C. Sections 1331 and

1337(a) for violations of the Lanham Act as provided in 15 U.S.C. Section 1 125(a)(l)(B). The

3. This Court has jurisdiction over this matter pursuant to 28 U.S.C. 1332 as the

Plaintiff James A. Ross is a citizen of the Commonwealth of Virgiraa, and Plaintiff Ross Group

L.L.C. is a corporation, mcorporated in and having its principal place of business in the

Commonwealth of Virginia; the Defendant James M. Atkinson cilbia The Granite Island Group is

a citizen of the State of Massachusetts; and the rnatter in controversy exceeds the surn of

$50,000.

4. The Plaintiffs also invoke supplemental jurisdiction of this Court pursuant to 28 U.S.C. Section 1367 over the Plaintiffs clairns against the Defendant for common law defamation and libel, as the common law clairns forin part of the same case or controversy.

III. Identity of the Parties

Plaintiff James A. Ross is a resident of the Commonwealth of Virginia, and the of Ross Group L.L.C.

6. Plaintiff Ross Group L.L.C. is a corporation incorporated in the Commonwealth of Virginia, with its principal place of business in Prince William County, Virginia.

7. Plaintiffs James A. Ross and Ross Group L.L.C. conduct business in the fields of surveillance and counter-surveillance technology. Plaintiff James A. Ross is an expert witness in the field of surveillance and countermeasures technology.

8. Defendant James M. Atkinson is the President of The Granite Island Group, an unincorporated business situated in the State of Massachusetts, and transacting business nationwide and in the Commonwealth of Virginia through Internet technology.
 
 
 
9. Defendant James M. Atkinson dibla The Granite Island Group purports to conduct business in the field of surveillance and counter-surveillance technology.

IV. Facts

10. The Plaintiff James A. Ross is the President and sole shareholder of the Ross Group L.L.C., and is responsible for the organization, promotion, and production of a for-profit industry trade show known as "Surveillance Expo."

11. The Plaintiff Ross Group L.L.C. earns all of its income from surveillance and countermeasures consulting, surveillance and countermeasures training classes, and the production and sale of an industry newsletter, "Privacy and Security 2001".

12. The Plaintiff James A. Ross is a graduate of the United States Military Academy at West Point, and holds an advanced degree in Electrical Engineering from the University of Illinois. A copy of Plaintiff James A. Ross's resume is attached hereto and incorporated herein as "Exnibit A".

13. The Plaintiff James A. Ross served in the United States Army in both enlisted and comnissioned, and active and reserve capacities, connnanding radio and wire communications. for the 7th Army in Gerrnany, and as a Research and Development Coordinator for the Army and NASA missile and space programs at Cape Canaveral.

14. Plaintiff James A. Ross has published two industry books, "Military Intrusion Detection Systems" and "Modern Warfare Electronic Surveillance."

15. Plaintiff James A. Ross has private industry experience as a senior engineer and manager with RCA Corporation, and Lockheed Corporation.
 
 
 
16. Plaintiff James A. Ross has experience as an Instructor of Electronics at the United States Military Academy at West Point, and as an Associate Professor and Associate Dean of the Capitol Institute of Technology, in Maryland.

17. Plaintiff James A. Ross offers services as an expert witness in the field of surveillance and countermeasures technology, and earns income from these services independent of Ross Group L.L.C.

18. On or about January 1, 1996, and continuing to the time of this action, Defendant published a commercial advertising web site on the Internet promoting his business, The Granite Island Group.

19. The Defendant's web site is located on the Internet's World Wide Web at "http://www.tscm.com", and is accessible to the public.

20. On or about January 1, 1996, and continuing to the time of~his action, the Defendant publishes on his web site, with the intent to damage the Plaintiffs' businesses and promote the Defendant's own business, and with the intent to cause the Plaintiff James A. Ross, mental distress and personal humiliation, the following malicious and false statements with regard to the Plaintiffs and their businesses:

A. "Ross... offers a very limited [surveillance countermeasures] training program, which is really nothing more than a very expensive one week lecture on basic electronics and simplified radio theory."

B. "This school tries to convince gullible students that all they have to do is buy a special five thousand dollar package of equipment from [Ross] to perform legitimate [surveillance countermeasures] sweeps...
 
 
 
C. "Mr. Ross has a reputation for his paranoid rants, lengthy raving diatribes against the government..."

D. "[Ross Group] is considered to be an inside joke within the... industry..."

E. "...[E]verybody laughs at [Ross] behind his back."

F. "The Privacy and Security Newsletter published by [Ross] is nothing more than a sham forum for the discussion of [Ross's] personal politics..."

G. "The Privacy and Security Newsletter reads more like the Turner Diaries...The newsletter also has strong overtones of the neo-nazi, skin head, white supremacist, anti-government, right wing, militia movements."

H. "Surveillance Expo is little more than a [sic] annual gathering of hackers, felons, drug dealers, phone phreaks, spy wanna-be's, cop groupies, and the occasional misguided member of the law enforcement or security community."

A copy of the printed version of the Defendant's web page is attached hereto and incorporated herein as "Exhibit B".

21. Upon information and belief, thousands of individuals, including existing and potential clients of the Plaintiffs, have accessed and read the malicious and false statements published on the Defendant's web site.

COUNT I: VIOLATION OF THE LANHAM ACT

FALSE ADVERTISING

22. Plaintiff incorporates herein by reference the allegations contained paragraphs 1 -

23. Contrary to the provisions of 15 U.S.C. Section 1125 (a)(1)(B), the Defendant has in connection with services, used in commerce on the Internet, malicious, fake and misleading statements about the Plaintiffs' services and products, in the context of commercial advertising and promotion of the Defendant's own business on the Internet.

24. The Defendant published this false advertising with knowledge of the falsity of the advertising and with the malicious intent to destroy the Plaintiffs' businesses.

25. Upon information and belief, members of the public who accessed and read the false advertising have been deceived and mislead by the Defendant's false advertising.

26. As a direct and proximate result of the Defendant's false advertising, the Plaintiff has suffered lost profits and damages in the sum of $250,000.00.

27. The actions described above were conducted by the Defendant with malicious intent, knowledge of the falsity of the published advertising, and were done for the sole purpose of causing harrh to the Plaintiffs; wherefore the Plaintiffs demand punitive damages in the sum of

$500,000.00.

COUNT II: LIBEL AFFECTING BUSINESS OF JAMES A. ROSS

28. Plaintiff incorporates herein by reference the allegations contained in paragraphs

1-27.

29. The Defendants actions described herein constitute disparaging, malicious and false statements ascribing to the Plaintiff James A. Ross conduct and characteristics that adversely affect his business as an expert witness and as the organizer, promoter and producer of the trade show "Surveillance Expo."
 
 
 
30. As a direct and proximate result of the Defendant's actions, the Plaintiff James A. Ross has suffered losses and damages as described above.

31. The Defendant's libelous publications were made with knowledge of their falsity or with reckless indifference as to the truth or falsity of the statements, and were made with the sole purpose of causing harm to the Plaintiff James A. Ross. Wherefore, the Plaintiff demands punitive damages as described above.

COUNT III: LIBEL AFFECTING BUSINESS OF THE ROSS GROUP L.L.C.

32. Plaintiff incorporates herein by reference the allegations contained in paragraphs

1-31.

33. The Defendants actions described herein constitute disparaging, malicious and

false statements ascribing to the Plaintiff Ross Group L.L.C., conduct and characteristics that adversely affect Plaintiff's business as a provider of consulting and training services, as well as the sale of the industry newsletter "Privacy and Security 2001."

34. As a direct and proximate result of the Defendant's actions, Group L.L.C. has suffered losses and damages as described above.

35. The Defendant's libelous publications were made with knowledge of their falsity or with reckless indifference as to the truth or falsity of the statements, and were made with the sole purpose of causing harm to the Plaintiff Ross Group L.L.C. Wherefore, the Plaintiffs demand punitive damages as described above.

COUNT IV: DEFAMATION OF THE PERSON OF JAMES A. ROSS

36. Plaintiff incorporates herein by reference the allegations contained in paragraphs
1-35.

37. Defendant's disparaging, rnalicious and false statements, published on the Internet and described in detail above, impute to the Plaintiff the commission of crimes involving moral turpitude that would be punishable by imprisonment.

38. Defendant's false and malicious publications accuse the Plaintiffof untruthiulness and dishonesty in the conduct of his business.

39. As a direct and proximate result of the Defendant's slanderous imputations of crime and dishonesty to the Plaintiff, the Plaintiff James A. Ross has suffered hurrijijation, emotional distress and damage to his personal and professional reputatio~

40. The Defendant's libelous, slanderous and defamatory publications were made with knowledge of their falsity or with reckless indifference as to the truth or falsity of the statements, and were made with the sole purpose of causing harm to the Plaintiff James A. Ross. Wherefore, the Plaintiff demands punitive damages as described above.
 
 

WHEREFORE, Plaintiffs request that this Court enter a temporary and permanent injunction against the Defendant, restraining the Defendant from continuing the electronic, Internet publication of the malicious and false statements described herein; and
 
 

WHEREFORE, Plaintiffs requests that this Court enter judgment against the Defendant and award the sum of TWO HUM)RED AND FIFTY THOUSAND DOLLARS ($250,000.00)
 
 
 
for compensatory damages and the sum of FIVE HUNDRED THOUSAND DOLLARS ($500,000.00) for punitive damages in favor of the Plaintiff for each Count herein, and the costs of this action, including reasonable attorneys fees, and for such other and flirther relief as the Court may deem appropriate.

This school is the best place to start, it will allow you to get a comprehensive understanding of the private sector security, investigative, and intelligence industries. Excellent Texts, Videos, and Manuals. VERY INTENSE PROGRAMS.

Highly recommend the AEP (600 hours), lOP (700 hours), AlP (600 hours), and optional PPSO (300 hours) program. All four programs can be finished during a two year time period. Strongly recommend that you complete the entire home study portion of their program before going to Colorado for the advanced training.

This is also a great program for folks in the military to complete while still on active duty. ESI is a good place to start as a base if you are interested in TSCM, or private sector counterintelligence and security.

Jil - Jarvis International Intelligence, highly respected, very desirable training.
Heavy emphasis on real world intelligence threats and lab time.
Recommend 20 days of training, 2 classes 10 days each. Don't buy any TSCM

Murray Associates, Kevin Murray is one of the most sought after TSCM instructors in the industry. He is a real gentleman, and I recommend that you attend any and all classes that he may instruct.

Martin L. Kaiser, Marty has been in the TSCM and EOD business for decades, and is one of the foremost authorities on the subject. His teaching is normally limited to short courses at government schools, when you hear of Marty teaching a class (which is very rare), attend it!

He periodically teaches TSCM courses at Texas A&M University System's Law Enforcement and Training Division.

Alexander Kalmanovich, Mr. Kalmanovich is a retired tradecrafi instructor who worked for the Komitet Gosudarstvennoy Bezopasnosti (KGB) for 46 years teaching technical surveillance and black bag operations at the Red Banner Institute. His area of expertise is the interception of wire based communications (wired microphones and
telephone intercepts).

He teaches an intense 10 week (850+ hours) technical tradecrafi program in Geneva, Switzerland, which is highly recommended, rigorous, and very expensive.

RAS - Research Associates of Svracuse, teaches a series of courses on Signal Intelligence, Emitter Location, ELINT Analysis, and similar classes. Excellent training
for the TSCM person, rather expensive, and most of the trair~g does require a security clearance.
Note: This school is taught by ex-NSA and NRO SIGINT analysts.

Granite Island Group offers closed enrollment classes for their corporate and government clients. Training is geared toward the realistic needs of protective details, full time corporate TSCM teams, and diplomatic details. Most training is designed for technical security and protective teams with several years of field experience.
 
 
 
 

addresses the threat posed by modern spread spectrum, digital modulation, store and forward, burst, and frequency hopping surveillance devices. Students learn the techniques used to locate bugging devices found in computers, workstations, and local area networks. Threat assessment, and intelligence analysis segments of instruction address the issue of developing technologies.

Duration of a typical technical class is five days, or forty classroom hours. Duration of a typical tactical class is between one to three days, or 8-24 classroom hours. Students will normally be exposed to an eight hour classroom day, however; any course may be delivered on an accelerated timetable (12-16 hours per day) at an additional cost. For example, the "Basic Technical Surveillance Counter Measures't program can be delivered as 2 three week blocks of instruction for a total of 520 classroom hours.

Classes are closed enrollment through May 2000, and are usually scheduled at least six months in advance (16-18 months typical).

Several courses are restricted to members of the U.S. Intelligence Community (as defined by EO 12333). All courses have background and technical training prerequisites.

All training is highly structured with rigorous written and practical exams. Roughly one third of all classroom time is straight lecture, one third is instructor led lab, and the balance consists of supervised practical exercises.

Seek information from other people who are more experienced and be willing to listen to their advice. Be humble and willing to learn fiom anyone-regardless of his station in life.

One good way to measure a person's character is to observe the way he treats people who can't possibly do him any good.

AT&T, periodically offers a TSCM school (10-12 weeks), but the student must have a graduate level degree (or Doctorate) in electrical engineering to get into the class. The course involves exploring the various technical vulnerabilities in the cellular systems, switches, OC systems, etc...
The school is very desirable, but VERY tough to get into (The last one was held Jun

investigators. Professional TSCM people tend to find this school an embarrassment to the industry. It's one of the least desirable schools to attend for TSCM training. Course goals and texts are designed for people with little or no technical background (cops). High of fluff, and low on content.

Don't recommend any training at this facility. Courses are taught around AID's very limited TSCM product line, which gives the user a false sense of security. It's a shame that this firm is permitted to do business with the government. Qui Docet, Discet!

In January 1997, Westinghouse formally announced that MD would no longer offer TSCM training, except by special request.

Note. This course is accredited by the state of North Carolina, the only state to require a specific TSCM license to

OBJECTIVE

To train each student to properly perform modern corporate technical sur,,'eillance countermeasures (TSCM). our motto, "Pert'ormance, Not Showmanship", describes the wav we work, and the way we'll train you to work.
 

COURSE ORGANIZATION

The course is organized into two 40-hour (class, lab, and homework) weeks, offered one week at a time. It has been set up this way because most of us who work for ourselves cannot be awav from our normal duties for two weeks at a clip. Also, it is a very intensive learning experience and better appreciated, we believe, when the t\vo weeks are separated.
Because of the split schedule, we make certain that, during the first week, every' student will operate every' necessary' piece of TSCM equipment and perform ever,,. necessar~' function. when students return for the second week, they have had much more time to study the course book, and are better prepared to ask questions in depth.
 

TSCM, WHAT IS IT?

Ross Group concentrates on the corporate threat, as contrasted with the government-to-government threat. however, our teams perform at a level that exceeds the government's in manv wavs. We do full technical sur,,'eillance countermeasures, not simply audio sur,'eillance countermeasures. We are involved with countering all types of sur,,'eillance -- audio, video, telephone, facsimile, computer hacker, etc.
We have created new techniques and procedures to counter modern threats. We do not perform the same tests that have been standard for fifty years (and outdated almost that long). The capabilities of modern electronic computer and communications s,'stems are changing at an unbelievable rate, and the countermeasures procedures and techniques that we use and teach are updated continuously to match the changing threat. In short, it's a practical, focused course.
OUR TRAINING PROGRAM, WHAT IT IS AND IS NOT

Hands-on" to us means that each student takes the equipment into his hands and makes it work. You will have vour technical questions answered, but vou will be learning equipment and techniques most of the time.

You will not:

be taught a copy of an old outdated government course, nor
have eight hours of lecture daily, nor waste time studying threats which no longer exist, nor
be required to do inconclusive tests or measurements, nor
be forced to memorize unnecessary' stuff like color codes, nor
use equipment that has no chance of detecting any communications compromise.

You will:

be taught modern methods, and learn what the technical terms mean, and
be taught by instructors with experience, and learn each instrument, and
learn methods of detecting the various threats to communications security.

WHY THE COURSE IS DESIGNED THIS WAY

We want our graduates to be prepared to perform modem countermeasures on their own. Each must feel confident and competent or we are not satisfied. That's whv we offer unlimited additional training for a ver,' reasonable fee.
One of the saddest stories that we ever heard involved a public utilitv company that had sent a member of the security department to a training course put on by the people who had sold his employer the equipment. He came back from the course, locked the equipment in a closet, and to this day refuses to even talk about the subject. In that case the company had made a wise decision, namely to do their own TSCM work in house, but could not accomplish it because the man who was trained had no confidence in what he was supposed to be d~ini,'.

During the course you will be given information on the equipment choices available to you. Full detail on the trade-of's regarding weight, price, performance, etc. is pro~'ided. If price, weight and portability are important, we'll definitely recommend a spectrum analyzer and low fre~uency receiver designed to our specifications. (Total price tag.. just over $5K) However, if your requirements are for something grander, we'll provide full information on what is available. Our feelings won't be hurt if vou do ~\e,t~bu~ our equipment; we know that everyone has his
requirements. In other words, the objective of this c&)ursc is not to sell equipment, it is to train TSCM tcchnicians in how to do it right.
 

FLEXIBILITY

order to accommodate the schedule requirements of working people, we have set up this course so you may take the first week of training during one scheduled course and the second week during a later course.

Further, if, after two weeks of training, you are not confident that you can properly do the job, you may return for additional training during any regular course. (For any additional weeks beyond the first two, there will be only a nominal fee for training.)

You may take as many weeks of training as you need to become competent and confident.
 

CLASS SIZE; TEAMWORK

Class size is limited to allow for ma;ximum personal attention to each student's needs. Teamwork will be emphasized.  Technical exercises will normally be worked bv teams in order to allow those students with more experience to help others with different backgrounds.
Lots of "give and take" with the instructors, all of whom are experienced in this field and believe in frank and open communication. Real information about specific thefts and countermeasures. Bunco artists claims examined and debunked. Most important: you will operate the equipment yourself; when we sav "hands-on" we mean "hands-on".
 

INSTRUCTORS

The chief instructor is James A. Ross who has been leading seminars and training sessions on TSCM since 1977. He is an engineer (BS, West Point; NISEE, University of Illinois) with experience teaching colle2e-level and technician-level electronics as well as TSCM. With over 45 years of professional experience in communications and electronics, he has performed TSCM services for many of the Fortune 500 companies and his seminars and training sessions have been attended bv security managers, private investigators, and government security professionals from all over the world. He will open the course and supervise the first experiments namely converting telephones into room bugs and then testing the bugs to be sure they operate properly. He is normally available on Monday and Tuesday to answer your questions and provide the benefit of his twentv vears of experience in the field.
The other instructors are Kevin Reierson of Ross Engineering Tri-State and Robert Kresson of Ross Engineering Pittsburgh. Both have years of real-world experience in TSCM to qualify them to teach this hands-on course.
