Subject: Motorola Logo and Copyright Information

It has come to my attention that the web site you run at "http://
www.l0pht.com:80/radiophone/" contains certain Motorola trademarks and copyright
information. By this letter I am requesting that you remove these items from
your site.

Specifically, when accessing the page located at "http://www.l0pht.com:80/
radiophone/jwz/motorola/mot.html", one sees the Motorola signature (the
registered trademark referred to by Motorola as the "M-signia" and the Motorola
name as registered with the Trademark Office). As you are not using this
registered trademark in connection with the authorized sale of genuine Motorola
goods or services, in in another legally permissable way, this constitutes a
misuse of our mark. Please remove this mark from your site.

Further, and more seriously, your site contains copies of Motorola-owned
software. The page located at "http://www.l0pht.com:80/radiophone/jwz/motorola/
eproms/motoprom.html" contains a number of files available for downloading. If
you will take the time to examine any one of these files, you will see that the
first line of each contains a legend of the form "COPR.MOTOROLA 89". This is a
copyright notice. This software was created by or for Motorola and the
copyright is owned by Motorola. Please remove these files from your site.

I sincerely hope that you will respond substantively to this letter. I assure
you that I will work with you to resolve this matter fairly. However, I will
warn you that last time Motorola tried to resolve a matter such as this amicably
by email, the individual in question refused to cooperate. In fact, he posted
our correspondence to his web site under the heading "Idiots with a Typewriter".
Motorola was forced to file a lawsuit against this individual, resulting in the
complete removal of his web site. It may interest you to know that the lawsuit
filed against this individual cited some of the same EPROM dump files that
appear on your site. I hope that you and I will be able to resolve this matter
at less expense to both of us.
