Bulgaria's Ex Top Prosecutor Due in Court over Bugging Trial

After two failures to appear in court, Bulgaria's former senior
prosecutor is expected to take the witness stand on Tuesday in a
bugging trial that has dragged on for years.

Nikola Filchev has been summoned as a witness in the so-called
Filchevgate. The scandal broke out in the summer of 2000 with the
discovery of special devices in his flat.

It is highly unlikely that Filchev will turn up in Sofia Military
Court on Tuesday. In an interview for a local daily a day earlier he
said that legislation prohibits him to be a witness.

"Bulgaria's Penal Procedure Code says that persons, who have already
taken part in legal proceedings but in a different capacity, can not
be summoned as witnesses," he told Trud Daily.

Wiretapping the chief prosecutor allegedly involved the then chiefs
of anti-organised crime and special forces.

Now defendants in the case are three former officials from the
Interior Ministry - Colonel Plamen Arsov, Boris Boyadzhiev and Yordan
Yordanov.

The trial against current MP Atanas Atanassov, head of the National
Security Service at that time, has dragged on in a number of primary
and appeals military courts. Atanassov was initially accused of
failing to dismantle the bugging devices, but in January 2005 the
Military Court of Appeals revoked his one-year suspended sentence.
