These two videos on the Fifth Amendment to the Constitution are
outstanding. A person should never talk to the police. The exception
would be instances when he is accompanied by his lawyer and on the
lawyer's advice. I spent six years in law schools (LL.B. and LL.M.)
and two years running a disciplinary tribunal in a federal max.
prison. After that I spent 12 years as a legal editor for a publisher
of law reports where I wrote summaries for thousands of legal
decisions. The one true thing that comes crystal clear from that
experience is never-ever speak to the police unless it is to file a
criminal complaint, etc. Even then, I would recommend you do so only
in the presence of a lawyer. Whatever you say, no matter how innocuous
and/or innocent, may come back to bite you on the ass. People are not
convicted by the legal justice system, they convict themselves with
their own big mouths.
Two weeks ago I was instructing a class in a restricted firearms
course. For some reason this issue came to mind at that time. I did
something I do not normally do, and that is take a time out and
instruct the 15 students never to speak to the police unless they had
to, eg. being pulled over on the highway. Just answer the questions
truthfully and never volunteer information. While such information may
seem harmless, It could provide sufficient grounds for the officer to
extend the examination or investigataion.
I also went on to advise them never to plead guilty to a misdomeanor
just to save money thinking it would be cheaper to pay the fine than
fight the charge in court. Misdemeanour convictions for various
offences that are harmless today could be seen in a different light in
the future. We saw in the 1990s how prior convictions for misodmeanors
in spousal disputes were elevated to the status of felonies as far as
the 2nd Amendment was concerned. Thousands of police and military
personnel lost their jobs because they had pleaded guilty to an
offence years earlier only because they wanted to save money and at
that time, a misdomeanor conviction was of little importance.
