Options Talent CEO Mark Tolner, and his associates, had a criminal past. The New York State Consumer Protection Board did issue a consumer alert about their practices.

On July 11, 2007, at a bond hearing, the Judge set a September 4, 2007 trial date in Federal Court for Pearlman on the bank fraud charges.
