Subject: [TSCM-L] {3890} Judicial TSCM "wave-offs"

Quoting "James M. Atkinson" <jm..._at_tscm.com>:

"law enforcement officers can not legally wave a TSCM'er off, only a sitting
judge can do that"

Interesting. Is there a legal "Table of Authorities" someone can post to
the list citing relevant federal case law on this? Or any relevant Federal
"Rules of Criminal Procedure"?

Having that info would be helpful to any TSCM practitioner facing an
attempted extrajudicial wave-off by a LE agency overstepping its
jurisdiction. Those situations are probably far more common that judicial
wave-offs; TSCM practitioners should come prepared to defend themselves.

Thanks much,

-Ed
