I wonder if the case law that may eventually come out of this will
address the very real possibility of a defendant forgetting their
password as being a valid defense. Millions of people forget their
password every year. Webmail providers like Google, Yahoo,
Microsoft,etc document statistics on this and provide all kinds of
recovery mechanisms (security questions, etc) so it obviously happens to
an awful lot of people.
Severe emotional stress contributes to memory lapses. And few
things are as stressful as being the target of the United States
Government--so just being investigated by them could easily cause someone
to forget their password. Oh, the irony!
How would the Feds prove someone didn't really forget your
password?
