Texas Court Tells The State To Give Kids Back

The Third Court of Appeals in Austin ruled that Child Protective Services did not present enough evidence at a hearing last month that their children were at risk of abuse to justify keeping them in state custody.

The court said that the state had not demonstrated that the children were in immediate danger and that Judge Barbara Walther abused her discretion in failing to return the children to their families.
 

Children To Be Returned To Mothers

The decision likely means that the children of the 48 mothers will be returned to their families at least temporarily. The state could also appeal the decision to the Texas Supreme Court.

 

Mothers Are Overcome

"Both TRLA attorneys and the mothers that we represent are ecstatic about this news," said Julie Balovich, an attorney for the mothers. "In ruling this way, the Third Court of Appeals has stood up for the legal rights of these families and given these mothers hope that their families will be brought back to together."
